The Sharks will consider loose forward acquisition Willem Alberts for their friendly matches next week and challenge SA Rugby to change the regulation prohibiting this.

The Golden Lions Rugby Union (GLRU) and the Sharks are currently in a contractual dispute about the services of Alberts and his former Lions team-mate Louis Ludik. The South African Rugby Union (SARU) has already indicated that it will not step in to resolve the matter.
Alberts and Ludik have still not received clearance certificates from the GLRU and SARU’s regulations prevent players from turning out for the Sharks while they are registered at the Lions.
However, Sharks chief executive Brian van Zyl expressed his disappointment on Wednesday that SARU did not want to step in to resolve the dispute.
He said that the Sharks would not hesitate considering Alberts for next week’s friendly matches against the Western Force and Stormers, even if Alberts may not be available because of his honeymoon.
Ludik is still recovering from a knee injury and will only be able to play in February again.
“We would like to resolve the matter. I think it’s rather a matter of SA Rugby having to revisit their regulations. It’s disappointing that they do not want to get involved,” he said.
He does not believe that arbitration, which may ultimately be necessary to settle the dispute, will keep Alberts and Ludik off the field.
“There was already arbitration in the Jaque Fourie case and the documentation is there for all to see,” he said.
The Fourie case prevented the player from playing in the Currie Cup for the Lions or Western Province.
Just like then, the GLRU maintains that it has contracts with Alberts and Ludik, while the Sharks dispute that.
SARU legal manager Christo Ferreira said this week that they will have to investigate the matter if a complaint is received when the Sharks pick the players.
The Sharks leave for Cape Town on Sunday to play in the friendly matches.
Alberts is expected to return from his honeymoon this weekend.

and why should should SARU revisit their regulations? why cant the sharks just offer a transfer fee
in SA every player, agent, team anyway just rape, rules regulations and contracts.

According to reports, the only reason why Fourie won his arbitration case was because their was no Remuneration filled in for 2010.
If that is the case, and Alberts and Ludick’s remuneration was filled in (as stated by Manie) then their contracts should be considered valid.
Although they both talented players, I don’t want them back at the lions. But the Sharks need to pay up, if they want them.
Saru should take action against these Bakvissies, if they go ahead and play them against regulations.

I was always under the impression that transfer fees is payable when a player transfer from one union to another.
If the sharks do decide to play the Ludick and alberts before this mess is sorted out, what type of action will Saru be looking at? a fine?

Maybe – but allthe bickering that goes on when a player wants to leave a Union
indicates that there can’t be transfer fees involved or then substantial fees.
A Union like Vrystaat would be smiling all the way to the bank – if substantial transfre fees were in place for their players they are constantly developing for other Unions, don’t you think?

Reynecke only mentioned that the fee or fee for next year was ‘discussed’ with the players which leads me to believe it is not in the contract.
According to Erasmus who represents the Sharks legally, the contracts are the same as Jaque’s to the last comma…
However, I do agree that a transfer fee should be standard if players are ‘bought’ out of their contracts.
SARU in any event HAS to get involved, I find it disgusting that they are passing the buck.

SARU’s gotta step in here… ridiculous that they’re not… the longer they don’t the more disruptive this will be to both unions… and look bad for SA rugby…
Although I do think the Sharks are being cocky if they play Alberts before the matter is resolved…
They must bite the bullet and not play him till it is okay to do so… WP had to wait for Jaque’s stuff to get sorted… the Sharks should wait for Willem’s to get sorted too…
